Ministry of Environment correction release Permit Management Regulations for Public or Private Waste Clearance and Disposal Organizations

In order to strengthen the integrity of the review process of waste removal and treatment agencies, clarify the principles of issuing permits, and cooperate with the promotion of environmental permit integration to strengthen the correlation of pollutant flow and registration consistency in various environmental permit, the "Permit Management Regulations for Public or Private Waste Clearance and Disposal Organizations” will be revised and promulgated by Ministry of Environment on May 17,2024. Three articles have been amended, and they will come into effect upon promulgation. The key points of this revision are as follows:

1. Clarify the permit review principles

When the issuing authority accepts applications, submissions, changes, or extensions for clearance permits, establishment approval documents, trial operation plans, and disposal permit, the scope of review shall not extend beyond the content of the applications, submissions, changes, or extensions, and shall not include arbitration in any form to impose obligations not expressly provided for by regulations. In addition, if the issuing authority discovers any obvious errors such as miswriting or miscalculation, it may correct those at any time.

2. Cooperate with the integration of environmental protection permits

Before applying for the issuance, change or extension of a treatment permit and a cleanup permit for the establishment of a storage site or transfer station, the applicant must first draw a schematic diagram of the pollutant flow of air, water, waste, toxic and chemical substances of concern, and if other types of environmental protection are involved Applications, changes or extensions of permission must be submitted at the same time. However, this does not apply if it is not substantively involved. If not raised concurrently, the issuing authority may proceed with the review.

3. Time limit for issuing permits in full

In order to prevent the application case from being delayed in the administrative agency due to incomplete issuance or receipt of the permit, the time limit for the issuance agency to complete the issuing permits operation has been added.

Ministry of Environment stated that this amendment will make the licensing authority's regulations for permit review clearer, help improve administrative efficiency, and avoid delays in issuing permits. It also reminds businesses involving Category 2 or above permits that future permit applications, changes, or when extending, a schematic diagram of the pollutant flow must be drawn first. Applications, changes or extensions for other types of environmental permits must be submitted at the same time.
