To strengthen source control of chemical substances, ongoing investigations and assessments are conducted to analyze the physical and chemical properties of these substances, their impacts on the environment, ecology and human health, as well as their handling within the country in compliance with the Toxic and Concerned Chemical Substances Control Act. The resulting information and findings are announced as references for regulatory controls. Currently, 341 types of toxic chemical substances and 18 types of concerned chemical substances are under regulatory control as announced. Simultaneously, management approaches such as prohibition, restricted use, permit, registration, and approval are adopted flexibly to align with international regulatory practices.
Those designated to handle the manufacture, export, import, sale, use, storage, and discarding of toxic and concerned chemical substances under regulatory control (hereinafter referred to as 'handlers') are required to obtain a permit, registration document, or approval document issued by the competent authority. Their practices must align with the contents of the permit, registration document, or approval document. Additionally, they are expected to maintain toxic and concerned chemical substance handling records using the format prescribed by the central competent authority. These records should be submitted to the municipal/county/city competent authority of the handling site location by the 10th of each month through online transmission. This process aims to enhance the control, traceability, and management of toxic and concerned chemical substances by competent authorities, thereby preventing their improper use.
Moreover, to enhance risk management, as well as hazard prevention and response, it is prescribed that, for the manufacture, use or storage of a single toxic chemical substance, if the total handling quantity of any of the said handling activities exceeds 300 tons per year or 10 tons per day, the handler should prepare a record of the quantity of the toxic chemical substance released using the format prescribed by the central competent authority. This record is then required to be submitted annually to the municipal/county/city competent authority of the handling site location. Handlers dealing with Class 1 to Class 3 toxic chemical substances and hazardous concerned chemical substances are also obliged to establish hazard prevention and response plans, which must be made public.
