On February 5 , 2026, the Ministry of Environment amended and announced Article 29, Article 42, and Appendix Table 6 of Article 46 of the "Standards for Determining Specific Items and Scope of Environmental Impact Assessments for Development Activities". This amendment was primarily made in response to the addition of Paragraphs 3 and 4 to Article 5 of the "Environmental Impact Assessment Act," which were passed on third reading by the Legislative Yuan on November 14, 2025, and promulgated by the President on November 28, 2025. These new provisions incorporate requirements for environmental impact assessments for the installation of solar photovoltaic power generation systems. Accordingly, Article 29 and Appendix Table 6 of Article 46 of these Standards have been reviewed and amended. In addition, to prevent potential environmental impacts arising from carbon dioxide capture and storage (CCS) sites, Subparagraph 7 of Article 42 of these Standards has also been amended and newly added.
In response to the aforementioned amendment to the Standards for Determining the Specific Items and Scope of Environmental Impact Assessments for Development Activities, Appendix 1 of Article 12 of the Enforcement Rules of the Environmental Impact Assessment Act has been amended to include a new category for carbon dioxide capture and subsequent storage (CCS) site development activities. Furthermore, the Ministry of Environment is designated as the competent authority responsible for conducting environmental impact assessments for such projects.
